General terms and conditions

Please read these terms carefully before using our services.

 

1) Definitions

General Terms and Conditions: The present General Terms and Conditions to the latest adopted text.

Operator: Taxionspot trading under the name Taxionspot.nl or taxionspot, located at Houckgeeststraat 13, 5643 VS in Eindhoven and registered with the Chamber of Commerce under number 65752376.

Customer: Visitor, natural person or legal entity, who places one or more Bookings through taxionspot.nl and thus enters into a Transport Agreement with Carrier.

Parties: Operator and Customer together.

Booking: the placing of one or more ride orders via taxionspot.nl whereby Operator forwards them to Carrier, and plays a facilitating role in the payment of the placed Booking(s).

Ride: Transport by taxi booked by Customer with Operator.

Offer: The offer made by Operator in response to the ride order placed by Customer through taxionspot.nl.

Carrier: a company that performs a Ride for Operator and has agreed a Transport Agreement with Operator for that purpose.

Driver: The person deployed by Carrier to perform the Ride.

Customer Fare: The fare for a Ride that Customer settles with Operator

2) Services

Operator provides a technical platform that enables Customer to book and purchase Rides from a Carrier.

Operator acts as an intermediary between Customer and Carrier and plays a facilitating role in the payment of the placed Booking(s).

The transport agreement is established between Customer and Carrier by placing a ride order by Customer through taxionspot.nl.

The identity of Carrier is made known to Customer immediately after booking the booked Ride, through an e-mail and SMS.

It is possible that the Carrier of a Ride may be changed, Customer will be notified of this in good time by e-mail and or text message.

Customer acknowledges that Operator does not provide transport services or act as a transport company and that transport is provided by Carrier, who is not an employee of Operator.

3) Applicability

The Terms and Conditions apply to the booking and purchase of Rides by Customer through taxionspot.nl.

Customer accepts the applicability of these Terms and Conditions as soon as Customer places a Booking through taxionspot.nl and therefore enters into a Transport Agreement with Carrier.

The provisions of these General Terms and Conditions apply in full; these provisions can only be deviated from in writing with the express written approval of Operator.

The General Terms and Conditions will be made available to Customer digitally before he makes a final Booking.

Unless expressly agreed otherwise and in writing, the applicability of other General Terms and Conditions is excluded.

If one or more provisions in these General Terms and Conditions should at any time be wholly or partially void or nullified, the other provisions of these General Terms and Conditions shall remain fully applicable. In that case, the Customer and the Entrepreneur shall consult to agree on replacing the void or nullified provisions. The purpose and purport of the original provisions will be taken into account as much as possible.

In the event of ambiguity regarding the interpretation of one or more provisions of these General Terms and Conditions, the interpretation must take place in the spirit of these terms and conditions.

Should a situation arise between the Customer and the Operator that is not regulated in these General Terms and Conditions, this situation should be assessed in the spirit of these Terms and Conditions.

Operator may amend these Terms and Conditions from time to time. The amended version will be published on taxionspot.nl and will apply to the Booking placed by the Customer. The Customer is advised to read the General Terms and Conditions (again) before placing a (new) Booking.

4) Customer requirements

The minimum age to book a Ride through taxionspot.co.uk is 18 years or older. Customer declares to be of age when booking the Ride. Operator has the right to verify the age of Customer. Should this not match the actual age, Operator has the right to terminate the Agreement with immediate effect and not perform the Ride. The Customer is not entitled to a refund in this case.

Customer, when placing a ride order through taxionspot.co.uk, shall enter a valid e-mail address and telephone number where he or she can be reached. Customer bears responsibility for the accuracy of his data, as well as for the accuracy of placing a Booking.

Operator is entitled to block Customer from taxionspot.nl and make booking of Rides impossible. If Entrepreneur decides to do so, Entrepreneur shall immediately inform Customer by e-mail and or SMS.

5) Obligations of the Entrepreneur

Operator will make every effort to ensure the proper functioning of taxionspot.nl, but cannot guarantee that it will function fully and uninterruptedly at all times. Operator shall at all times make every effort to solve any (internet) malfunctions or other problems with the functionality and accessibility as soon as possible.

Customer can ask questions to Operator and, within 7 days after execution of the Ride, submit complaints about the handling of the Booking and/or Carrier's service. After this period, taxionspot has the right not to consider the complaint.

Operator is responsible for processing payment from Customer in relation to the Booking placed by Customer. Operator bears the debtor risk in the event of non-payment by Customer and is entitled to initiate collection measures.

6) The Offer

The Offer by Operator on behalf of Carrier to Customer is without obligation. Operator is entitled to change and adjust the Offer. If Operator proceeds to do so, it will inform Customer.

Each offer contains such information that it is clear to the Customer what rights and obligations are attached to the acceptance of the Offer. Furthermore, the offer contains a complete and accurate description of the offered services. The description is sufficiently detailed to enable a proper assessment of the offer by the Customer.

All specifications and data in the Offer are an indication from which no rights can be derived and cannot be a reason for compensation or dissolution of the agreement.

7) Booking a ride

Customer can book a Ride to Eindhoven from Entrepreneur throughout the Netherlands through the online booking system at taxionspot.nl. Customer can book a Ride for within 20 minutes or Customer can book a Ride for a later time.

For Rides from the airport, Customer must provide the flight details when placing the Ride Order so that Carrier can take these into account. If Customer has not provided the flight details, the pick-up time specified by Customer will be leading for Carrier.

After Booking, Customer will immediately receive a confirmation of the booked Ride on the specified email address and a text message on the specified phone number. After termination of ride, Customer will receive an email address to leave a review.

If the data provided by Customer turns out to be incorrect, Customer can amend it on his overview page. Should this fail, Customer should contact taxionspot.

Customer bears responsibility for the accuracy of his data, as well as for the correctness of placing and checking his Booking. Operator is not liable for incorrect (flight) data transmitted by Customer.

It is possible to bring extra luggage, special luggage during the Ride. Customer must indicate this when booking the Ride. Should it still not be possible to take along, Carrier will contact Customer and a solution will be sought.

If Customer takes such a large amount of luggage that the use of a taxi van or multiple taxis is necessary, Customer must ensure that he books the correct transport category or multiple taxis. Should this not be done, taxionspot is entitled to charge extra for this.

It is possible to take small children along on the Ride. In doing so, Customer is responsible for bringing a child seat.

8) Cancelling or changing a ride

Customer has the right to change or cancel the Ride up to 2 hours before the agreed pick-up time. Any amounts paid will be refunded in full (minus any transaction fees). A cancellation must be communicated to the Carrier by telephone, as well as via taxionspot's online cancellation environment. Online cancellations are only possible if Customer has an account with taxionspot. If the pick-up location of the Ride is changed, additional charges will apply if the pick-up location is further from the previously specified address. These must be paid in cash to Carrier. The same applies to intermediate stops not specified in the Booking. If the Ride is cancelled less than 2 hours in advance, Customer is not entitled to a refund. Operator is entitled to cancel a booked Ride up to 24 hours in advance for any reason. In doing so, Customer will be refunded the amount already paid, but is then responsible for arranging (and paying for) replacement transport.

9) The execution of a ride

Chauffeur will pick up Customer at the agreed time, at the front door of the address specified by Customer. If this place is not accessible by vehicle, Driver will park his vehicle as close as possible and inform Customer accordingly. For Rides from the airport, Customer must call Carrier after landing of the flight to arrange where to meet. Customer must be able to identify himself to Driver by means of the confirmation e-mail address or confirmation text message received. Customer is responsible for the accuracy of his data, as well as for the correctness of placing and checking his Booking. Should there be more passengers and/or luggage during the execution of the Ride than entered in the Booking by Customer, Driver is not obliged to take the extra passengers and/or luggage. The Ride will be carried out according to the the General Terms and Conditions for Taxi Transport of the trade association KNV Taxi . If these Conditions differ from these General Conditions in any respect, the latter shall prevail. If no taxi has arrived at the Customer's premises ten minutes after the agreed time, the Customer must always first contact the Carrier via the telephone number provided. If telephone contact is unsuccessful or Carrier indicates that the taxi will not be there on time, Customer should contact via taxionspot's emergency number. This number can be found on the taxionspot website. A solution will then be sought together.

10) No show Customer and waiting time Driver

Customer is not entitled to a refund if there is a 'no show'. A no show occurs if Customer is not present at the agreed location within ten minutes of the agreed pick-up time. In the meantime, Carrier is obliged to make demonstrable attempts to contact Customer. For transport from the airport, a different waiting time for Driver applies, namely one hour and ten minutes after landing of the Customer's flight. The flight details communicated by Customer at the time of Booking shall serve as the basis for this. Carrier will monitor the flight. In addition, Customer is obliged to keep Carrier informed of delays at the airport, using the telephone number given on his confirmation email address. If the Customer has not provided a flight number or has not provided a correct flight number, Article 10.1 will automatically come into effect. In this case, the completed pick-up time will be maintained. If the waiting time exceeds one hour and ten minutes after landing of the aircraft, Driver is entitled not to have to wait and it is considered a no show. In consultation with Customer, it may be agreed to wait. Driver is entitled to charge a waiting fee for this, which can be paid in cash in the taxi. If the actual landing time differs so much (at least 3 hours) from the original landing time that it becomes difficult for the Carrier to carry out the Ride, a solution can be sought in consultation with taxionspot. Should this not succeed, Carrier shall be entitled not to have to perform the Ride and the Ride will be cancelled. Customer will be refunded the full amount paid (minus any transaction costs), but is responsible for arranging (and paying for) replacement transport.

11) Payment

A Ride booked by Customer with Operator must be paid in advance to Operator. The Booking is not final until it has been paid. Payment can be made via various payment methods. Operator may charge a surcharge for certain payment methods. If a surcharge applies, this will be stated in the booking process under payment methods. Toll and ferry fees, as well as costs for extra kilometres driven due to the Customer changing the route after boarding with Driver, must be paid directly to Driver. Any gratuity is not included in the price. The Customer is free in whether or not to tip Driver and the amount thereof.

12) Liability

Operator acts as an intermediary for Carrier and plays a facilitating role in the payment of the placed Booking(s). The transport contract is established between Customer and Carrier after Customer places a Booking through taxionspot.co.uk. Operator shall not be liable for any damages of any kind, including lost profits, lost data, personal injury, or property damage relating to, in connection with, or otherwise arising from the use of the (transport) services offered by Carrier. This responsibility and liability rests with Carrier, in accordance with Article 12 of KNV Taxi's General Conditions of Taxi Transport. Operator shall not be liable for any delay or failure arising from causes beyond its reasonable control. In no event shall the total liability of Operator for services provided to Customer exceed five hundred euros (€500).

13) Privacy

Operator enables Customer to create an account on taxionspot.nl, whereby personal data is entered and stored. Operator will respect the privacy of Customer and handle the obtained (personal) data with care. This in compliance with the General Data Protection Regulation (AVG). When booking the Ride, Customer agrees to provide the required personal data to Carrier. Operator reserves the right to approach Customer for things such as newsletters, win promotions, presents, et cetera. This can be done both online and offline, but only to the (email) addresses provided by Customer.

14) Intellectual property

All intellectual property rights pertaining to and/or resulting from the services provided by Entrepreneur rest with Entrepreneur. The Customer only acquires the rights of use expressly granted by these terms and conditions and the law. Any other or further right is excluded. The documents provided to the Customer by the Operator are exclusively intended to be used by the Customer. The Client is not allowed to disclose and/or reproduce obtained information in any form whatsoever. This includes processing, selling, making available, distributing and integrating - whether or not after processing - in networks. All information provided by Operator shall remain the property of Operator. The Operator reserves the right to use the knowledge acquired during the execution of the work for other purposes, provided that no confidential information of the Client is disclosed to third parties in the process.

15) Applicable law

These General Terms and Conditions and the Agreement between the Customer and Operator are governed by Dutch law. Any dispute arising from or related to these General Terms and Conditions and/or Agreement shall be submitted to the competent court in the place of business of Operator.
